Georgia laws and regulations for independent living communities

Because independent living communities in Georgia don’t provide personal care services or skilled nursing care, they are not licensed or regulated by a state agency like other senior living facilities.

Stand-alone independent living communities

Stand-alone independent living communities can be compared to an apartment building where residents don’t require access to higher level supportive services. These communities must adhere to state rental laws, which are outlined in the Georgia Landlord Tenant Handbook. City or county governments may have additional rental laws that regulate landlord tenant relationships.

An example of Georgia’s rental laws include the following:
• Landlords cannot discriminate based on a person’s race, color, religion, sex, national origin, familial status, or disability.
• Landlords have a duty to ensure a unit is safe and habitable by maintaining the building structure, electric, heating and plumbing.
• Tenants cannot substantially alter a leased property without the landlord’s permission.
• The landlord cannot keep the security deposit to cover normal wear and tear.
• Landlords cannot remove tenants or prevent access to a unit without first going through the court eviction process.

The Americans with Disabilities Act (ADA) protects tenants living with a disability from housing discrimination. The act requires landlords to make reasonable accommodations and allows a resident living with a disability to make reasonable modifications to their living space. The following examples of reasonable modifications or accommodations:[02]
• Hand rails and or grab bars
• Wheelchair ramp
• Assigning an accessible parking space
• Allowing a service animal
• Lower light switches

Most independent living communities in Georgia have age requirements, which are typically posted on the community’s website. Some communities require individuals be a minimum age of 55 while others set the minimum age at 62. Communities may have additional admission requirements to ensure residents don’t require a higher level of assistance than what the community is capable of providing.
